1. About HVM and these terms

HVM is provided by Vamberic Studio Ltd (company number 17480014), registered at Park Bridge Farm, Isington, Alton, Hants, GU34 4PL, United Kingdom. HVM is for business use, not personal consumer use. You must be at least 18 and authorised to enter into an agreement for the business you represent. These terms describe the conditions for access to our website and application. Any separately agreed order or service agreement governs the services, fees and commitments specified in it. These terms do not retrospectively replace an existing agreement merely because we publish them.

HVM supports marketing operations through structured records, research and AI-assisted functions. Availability depends on the functions enabled for your workspace. A roadmap, demonstration or recommendation does not guarantee that a capability is available or authorised to run.

2. Accounts and workspace authority

You must have authority to act for the organisation whose workspace you manage, provide accurate account information and keep credentials secure. Client administrators manage their own workspace; delegated managers act within the permissions granted to them. Global administration remains separate.

You are responsible for authorised users and for promptly removing access that is no longer appropriate. Tell us about suspected misuse. Permission to use a workspace does not itself authorise purchases, billing exemptions, mailbox access or external communications.

3. Your data and content

You retain your rights in the information and materials you provide. You permit us and our service providers to process, store and transmit them as necessary to deliver the services you request, subject to the applicable agreement and our Privacy Policy. You must have the rights and lawful basis needed to provide and use them.

You are responsible for the lawfulness of research, contact records, targeting and communications you instruct HVM to perform. Respect suppression requests, privacy rights and applicable electronic-marketing rules. Data-processing terms must govern processing we undertake on your behalf; this page is not a substitute for those terms.

4. AI results and approval

AI results are drafts or recommendations unless explicitly approved through the applicable workflow. They may contain errors, omissions or unsupported suggestions. Check facts, rights, commercial commitments and suitability before use. HVM does not guarantee sales, engagement, accuracy or a particular commercial outcome.

Saving a draft, connecting a service or receiving a recommendation is not approval to publish or send it. You must give any authorisation required by the relevant workflow. You should not use HVM outputs as a substitute for professional legal, financial or other regulated advice.

5. Acceptable use

Do not use HVM for unlawful, deceptive or abusive activity; unsolicited communications that breach applicable law or provider rules; unauthorised access; infringement of others’ rights; malware; attempts to bypass workspace permissions; or disruption of the service. Do not misrepresent your identity or upload data you are not entitled to process. We may restrict activity to investigate or prevent misuse.

6. Connected services

You choose which services to connect and must have authority for each account. Third-party terms and policies continue to apply. Availability, access restrictions and charges may be controlled by those providers. We do not guarantee uninterrupted access to external services.

A Gmail connection permits the functions described in the connection interface; it does not activate a campaign. Disconnecting removes HVM’s usable access for that workspace but does not recall sent email or automatically delete stored records. Revoking Google’s application grant can affect other connections for the same Google account.

7. Charges and service arrangements

Fees, subscription periods, renewal and cancellation arrangements are those expressly agreed with you. This page does not introduce a new charge, automatic renewal or payment obligation. Third-party charges are governed by the relevant arrangement. Any exemption must be expressly authorised and does not automatically cover external services.

8. Availability, suspension and ending access

We may maintain or update the service and restrict access where necessary to address security, unlawful use or a material breach, subject to any applicable agreement. Where practicable, we will explain the issue and give an opportunity to resolve it.

You may request closure through the HVM team, subject to your service agreement. Ending access does not undo actions already taken or replace data-retention obligations. Export, deletion and retention are handled under the applicable agreement and Privacy Policy.

9. Responsibility and legal rights

We will provide the service with reasonable care and skill. Unless a separate agreement provides otherwise, our total liability arising out of the service in any twelve-month period is limited to the greater of £500 and the fees you paid or owe for that service in the six months before the event giving rise to the claim. This cap does not apply to breach of confidentiality, breach of data-protection obligations or infringement of intellectual-property rights. Nothing in these terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be limited. This clause does not remove any rights or remedies that cannot lawfully be excluded or limited.

10. Governing law and disputes

These terms and non-contractual disputes connected with them are governed by the law of England and Wales. Subject to any mandatory legal requirement, the courts of England and Wales have exclusive jurisdiction. Please contact us first where practicable so we can try to resolve a concern.

11. Changes and contact

We may propose changes as the service develops and will communicate material changes appropriately. Your existing agreement determines how contractual changes take effect. For questions, complaints or to discuss ending your service, contact hello@h-v-m.net.
